My mother is a chronic alcoholic.  She was sober for 6 years (from alcohol, not vicodin)  until she had a stroke(8 months ago).  A couple of months ago I was at my wits end with her drinking (at least a fifth a day) and she said she wanted help.  We ended up taking her to the hospital and her BAC was .458.  Not uncommon for a drunk but still very high since she takes plavix and asprin(325mg).  They admitted her because she had pneumonia and she detoxed there.  She refused rehab and has been ok for 2 months.  Her roomate called me tonight and told me she's been on a 3 day binge.  What can I do now?  I can't watch her try to kill herself again.  (This has been an on-going problem for 20 years that I am aware of and now I have my own family to deal with)  What should I do?  Can I make her leagally incompatant and force her into treatment?  If I can't I'm afraid she will just kill herself.  I just don't know what to do.  Please help.I just want to add, she is not elderly, only 58, she had no will or insurance.  I do have a medical POA to refuse advanced life support, but thats it.

By definition incompetence is "The inability, as determined by a court, to handle one's own personal or financial affairs.A court may declare that a person is incompetent after a hearing at which the person is present and/or represented by an attorney. A finding of incompetence may lead to the appointment of a conservator to manage the person's affairs. Also known as "incompetency."If you take your mother to court on this and really prove that she is unable to take care of herself because of her drinking and bindges, you can request to be the "conservator" [somewhat like power-of-attorney] to handle your mothers affairs and have her commited to rehab.Also because your mother is elderly if she has placed you on her will as primary caretaker in the event of illness or anything like that you should find out because then I believe you have jurisdiction to make health decisions for her.If you want to become the conservator first of all you should contact a lawyer and discuss a plan with him, and if you do plan on going to court over this to make sure of your mothers wellbeing, you must must MUST do your research on rehabs and rehabilitaion programs and whatnot.Just make sure the roommate isn't lying about the bindge, talk to your mother first and tell her that if she doesn't quit it your going to have her put in rehab.I would really contact your attorney and see if he or she can help you with any legalities you might find if your mother refuses to take any type of treatment whatsoever again.Best of luck, and I do hope everything turns out for the best.
